Your Will
Your will is a legal document that allows you to assign how non-beneficiary assets will be distributed upon your death.
The Creation of Your Will
For your will to be legally binding in the State of Pennsylvania, the following must apply:
- You must have been at least 18 years old and of sound mind when you wrote your will. Being of sound mind means recognizing the legal implications.
- Your will must be in writing; typed, printed, or handwritten. If handwritten, it must be fully in your handwriting and signed by you.
- Your will must be signed by you, or by someone you direct to sign it on your behalf if you’re physically unable to sign it yourself.
Whether you need witnesses depends on the type of your will. A holographic will, fully handwritten and signed, needs no witnesses in Pennsylvania. An attested will, typed or printed, requires at least two witnesses.
Regardless of type, it’s best to have two disinterested witnesses sign your will. Having them sign your will before a notary makes it self-proving, which usually removes the need for probate validation.
